Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Dokanly platform, websites, dashboards, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

Description of the Service

Dokanly is an e-commerce platform that lets merchants build, host, and operate their own online stores, manage products and inventory, receive orders, and accept payments.

The Service is offered on a prepaid, pay-as-you-go basis: you top up a wallet balance, and fees for the features and usage you consume are deducted from that balance. Except where required by applicable law, wallet amounts that have been consumed for services already provided are non-refundable.

Accounts and Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly at support@dokanly.com of any unauthorized use.

Merchant Responsibilities

You are solely responsible for your store, the products and services you offer, and their compliance with all applicable laws. You may only sell lawful products and services and must provide accurate descriptions, pricing, and fulfillment.

You are the controller of your customers’ personal data and are responsible for handling it lawfully, including providing your own privacy notices and obtaining any required consents.

You are responsible for determining, collecting, reporting, and remitting any taxes, duties, or levies that apply to your sales.

Acceptable Use

You agree not to use the Service to sell illegal, counterfeit, or prohibited goods; to engage in fraud, deception, or money laundering; to infringe intellectual property or privacy rights; to distribute malware; or to violate any applicable law.

You agree not to interfere with or disrupt the Service, attempt to gain unauthorized access to it, reverse engineer it, or use it to send spam or unlawful communications.

Billing and Wallet

The Service uses a prepaid wallet. You add funds ("top-ups") to your wallet, and applicable fees are deducted as you use features and services. Prices and fees may change, and we will make current pricing available in the Service.

Top-ups and consumed usage are non-transferable between accounts. Except where required by applicable law, fees for services already rendered are non-refundable. Unused wallet balances may be subject to retention and handling terms described in the Service.

Payments and top-ups are processed by our payment provider, Paymob. You are responsible for any charges incurred through your account.

Intellectual Property

The Service, including its software, design, and content provided by Dokanly, is owned by Dokanly or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of the content you upload, such as your product data, images, and store content. You grant Dokanly a license to host, process, and display that content solely to provide the Service.

Third-Party Services

The Service integrates with third-party providers, including Paymob for payments and shipping carriers for delivery. Your use of those services may be subject to their own terms and privacy policies. Dokanly is not responsible for third-party services and does not control their acts or omissions.

Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the Service, other users, or third parties. You may stop using the Service at any time and request account deletion as described on our Data Deletion page.

Upon termination, your right to use the Service ceases. Certain provisions that by their nature should survive termination will remain in effect, including billing for amounts owed, disclaimers, and limitations of liability.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, Dokanly and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

To the maximum extent permitted by law, Dokanly’s total liability for any claim relating to the Service will not exceed the amounts you paid to Dokanly for the Service in the three months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Dokanly and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your store, the products or services you sell, your content, or your violation of these Terms or applicable law.

Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the competent courts of Egypt for any dispute arising out of or relating to these Terms or the Service.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
